These Terms & Conditions ("Terms") apply to your use of viburnumhome.com and purchases from Viburnum Home. By using the website or placing an order, you agree to these Terms.
1. Products, Handcrafted Pieces, and Natural Variation
Viburnum Home offers faux botanicals, faux arrangements, preserved moss pieces, home accents, candles, vessels, baskets, trays, and other decorative products. Many preserved moss pieces and arrangements are handcrafted or custom assembled, and no two pieces are exactly alike.
Faux stems, florals, foliage, preserved moss, preserved botanicals, handmade vessels, and decorative objects may vary slightly in color, texture, shape, positioning, fullness, finish, or dimensions. Preserved materials may naturally change in appearance over time or in response to light, humidity, handling, or environmental conditions. These inherent variations are part of the character of the product and are not necessarily defects.
2. Product Images and Styled Photography
We make reasonable efforts to accurately depict our products. Screen settings, lighting, photography, and natural or handmade variation may affect how colors and details appear. Furniture, books, vessels, stems, flowers, plants, candles, trays, and other styling props shown in photographs are not included unless the product description specifically states that they are included.
3. Availability, Pricing, and Orders
Products, prices, promotions, and availability may change without notice. We reserve the right to limit quantities, discontinue products, correct errors, or decline or cancel an order when reasonably necessary, including for inventory issues, pricing errors, suspected fraud, or shipping limitations. If we cancel an order after collecting payment, the applicable amount will be refunded.
4. Payment and Taxes
Prices are stated in U.S. dollars unless otherwise indicated. Applicable taxes and shipping charges are calculated or disclosed at checkout. Payments may be processed through Shopify or third-party payment providers. If Shopify or another payment provider offers an installment or "pay over time" option, that is a payment method for a one-time purchase and does not create a recurring product subscription with Viburnum Home.
5. Pre-Orders and Expected-to-Ship Dates
Items identified with an "Expected to Ship" date or similar pre-order language will ship when they become available. Expected dates are estimates and may change. Viburnum Home may charge for a pre-order at checkout, as disclosed at the time of purchase. We will make reasonable efforts to communicate materially extended backorder delays.
6. Custom and One-of-a-Kind Pieces
Some Viburnum Home pieces are custom made, hand assembled, or one of a kind. Product-specific terms, lead times, or return restrictions stated on the product page form part of these Terms.
7. Intellectual Property
The Viburnum Home name, website content, product photography, graphics, descriptions, designs, and other original materials are owned by or licensed to Viburnum Designs LLC and may not be copied, reproduced, republished, or used commercially without permission.
8. Acceptable Website Use
You may not misuse the website, interfere with its operation, attempt unauthorized access, use automated means in a manner that disrupts the site, or use the website for unlawful purposes.
9. Third-Party Services
The website may use or link to Shopify and other third-party services. Viburnum Home is not responsible for third-party websites, services, or privacy practices outside our control.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Viburnum Home and Viburnum Designs LLC will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products. Nothing in these Terms limits rights or remedies that cannot legally be limited under applicable consumer law.
11. Governing Law
These Terms are governed by applicable laws of the State of New Jersey and the United States, without limiting any mandatory consumer rights that apply under other law.
12. Compliance with Law
Viburnum Home will process orders, shipments, refunds, marketing communications, and personal information in accordance with applicable federal and New Jersey law. Nothing in these policies is intended to waive or limit consumer rights that cannot legally be waived or limited.
13. Changes
We may update these Terms from time to time. Updated Terms will be posted on viburnumhome.com.
